Terms of service

These terms are the agreement between you and [Local Record legal entity name] ("Local Record", "we", "us") for using localrecord.app and our apps. By creating an account or buying a ticket you agree to them. If you use Local Record for an organization, you agree for it too and confirm you are allowed to.

Your account

  • You must be at least 13 to use Local Record, and old enough in your country to agree to these terms (with a parent or guardian's permission if you are under 18). Some shows have their own age limits; they are the venue's to enforce.
  • Sign-in is by a code sent to your email. Keep access to that inbox safe; you are responsible for what happens under your account.
  • Use your real name or the name you are known by in the scene, and do not pretend to be someone else, a band you are not in or an organization you do not work for.
  • You can delete your account at any time from Settings.

Organizations: bands, venues and professionals

Curators run artist, venue and professional organizations on Local Record. If you create or join one you confirm you are authorised to act for it. Owners are responsible for who they invite and for everything the organization publishes: show listings, profiles, prices, refund terms, broadcasts and messages. Local Record staff review organizations and may approve, mark, edit, hide or remove listings that break these terms or are inaccurate.

Booking tools (holds, offers, settlements, budgets) are paperwork between the organizations involved. Local Record is not a party to those deals, does not guarantee them and moves no money under them.

Tickets and refunds

When a show sells tickets on Local Record, the organization named as the seller (the payee) is selling them to you. Local Record provides the checkout as a platform and collects payment on the seller's behalf through Stripe. The price you see before you pay includes the ticket, the show's own fees, Local Record's per-ticket fee and card processing; tax is shown before you pay where it applies.

  • Refunds are set by each show's refund terms, shown on the event page before you buy. Unless those terms say otherwise, sales are final except when a show is cancelled, postponed or moved, in which case you can get a full refund of what you paid.
  • If a show is cancelled, postponed or moved, we email ticket holders and people who said they were going. The organizer handles refunds and is responsible for them; we make the refund tools available and will help where we can.
  • Tickets are for personal use. Do not resell them above face value, copy them or use bots to buy them. A ticket code can be used once at the door.
  • Tips you add go to the show's seller for the act named, with no Local Record fee.
  • The seller, not Local Record, is responsible for the show itself: the lineup, times, venue, age policy, safety and anything that happens there.

Organizations that sell tickets agree to Stripe's Connected Account Agreement, keep their payout account in good standing, honour their refund terms and the law (including consumer, fee-disclosure and tax rules), and handle chargebacks and refunds on their orders.

Broadcasts and fan data

Organizations may email only people who said yes to hearing from them, only through Local Record's broadcast tool, and only about their own music, shows and news. They may not buy, import or add email lists, disguise who is sending, or send more than our limits allow. Contact details exported from Local Record may be used only under the consent the fan gave and must be deleted when the fan withdraws it. We may suspend sending for an organization whose mail draws complaints or bounces.

What you post

You keep ownership of what you post: photos and videos of shows, show listings, bios, press photos, messages and the rest. You confirm you have the right to post it (including permission from anyone identifiable in it where the law requires, and from the photographer if it is not you).

You give Local Record a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, resize and distribute what you post on Local Record and in our apps, and to show it when promoting Local Record and the shows it belongs to (for example, attendee photos on an event page, a venue page or an artist's profile), for as long as it is on Local Record and for a reasonable time after it is removed. You can ask us to remove your posts at any time through Help & feedback.

Artists and organizations using Apple Music artwork, previews or other third-party content on Local Record must follow those providers' terms.

Acceptable use

Do not use Local Record to:

  • harass, threaten, dox or discriminate against anyone, or post hate speech or sexual content involving minors;
  • post listings for shows that are not happening, misstate prices or fees, or sell tickets you do not have the right to sell;
  • send spam or unsolicited messages, or message people who have blocked you through another account;
  • post content you do not have the rights to, or infringe anyone's intellectual property or privacy;
  • scrape, overload, probe or break the service, get around its limits, or access accounts or data that are not yours;
  • break the law, including consumer protection, anti-spam, privacy and ticketing laws.

We check content against these rules and may review, hide, edit or remove anything that breaks them, and suspend or close accounts and organizations that do. Report problems through Help & feedback.

Other services

Local Record links to and relies on other services, such as Apple Music, Stripe, and the directory entries in our Resources section. Their terms apply to your use of them, and we are not responsible for them. Some links in our Resources directory are affiliate links; we mark them where they appear.

Disclaimers

Local Record is provided "as is". Listings come from us, from organizations and from public sources, and can be wrong or change; check with the venue before you travel. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise the service will be uninterrupted or error-free.

Limitation of liability

To the extent the law allows, Local Record is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, and our total liability for any claim about the service is limited to the greater of the fees you paid Local Record (not the ticket price paid to the seller) in the 12 months before the claim, or US$100. Some places do not allow these limits, so they may not apply to you. Nothing here limits liability that cannot be limited by law.

If you use Local Record for an organization, you will cover Local Record's reasonable costs from claims by others arising from your organization's shows, listings, ticket sales, broadcasts or breach of these terms.

Ending your use

You can stop using Local Record and delete your account at any time. We may suspend or end access that breaks these terms or the law, or that puts others at risk, with notice where reasonable. Sections that by their nature should survive (tickets already sold, licences for content already shared, disclaimers, liability and disputes) do.

Governing law and disputes

These terms are governed by the laws of [State], USA, without regard to conflict-of-laws rules, and disputes will be heard in the state or federal courts of [County, State], unless the law where you live gives you the right to bring a claim at home. Before filing a claim, write to us through Help & feedback so we can try to resolve it informally within 30 days.

Changes

We may update these terms as Local Record changes. We will change the date at the top and, for significant changes, tell you by email or in the app before they take effect. Continuing to use Local Record after that means you accept the new terms.
